Information on the security of personal data

In this Privacy and Cookie Policy, we present to you the rules for the processing and protection of personal data and the use of cookies and other technologies, such as: Google Analytics, Facebook Pixel in connection with the Users' use of the Fortis Detox Website.

1. What do the definitions used in the Privacy Policy mean

Administrator  – FORTIS MEDICA limited liability company with its registered office in Brodnica at the address 18. Stycznia 22 87-300, NIP (Tax Identification Number):  8741775879_cc78_numer-bb3cf -136bnumer5cde 0000429185 with share capital fully paid up: PLN 50,000 (say: fifty thousand zlotys).

FORTIS DETOX - website run at the internet address fortisdetox.com , by means of which the Administrator provides electronic services to Specialists and Patients, hereinafter referred to as the Website.

User  - any entity that browses the content of the Website.

Patient â€“ User using or intending to take advantage of Telemedicine Consultations provided via the Website.

Specjalista  - a user who is an entity that has the right to practice the profession of a doctor or other specialist with the required permissions and / or qualifications,   which he concluded with Fortis Medica sp. Z oo, the subject of which is the implementation of Telemedicine Consultations via the Website.

Means of distance communication â€“ are electronic devices with software (eg smartphone, tablet, laptop) using data transmission enabling individual communication at a distance (e-mail, chat, video call, telephone conversation). With their help, the User may transfer his personal data to the Administrator.

RODO â€“ Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95 / 46 / EC

2. What personal data do we process?

The personal data processed by the Administrator may include the following scope of Users' data:

  • Contact details, in the case of a Patient: name, surname, e-mail address, in the case of a Specialist: name, surname, e-mail address, telephone number,

  • Data required to conclude the contract:   their scope is still specified in detail in the Medical Interview (in the case of a Patient) and the Contact Form (in the case of a Specialist). These forms are available on the Website.

  • Data of special categories, in particular health data provided by the Patient in the form in order to arrange a Telemedicine Consultation with a Specialist.

  • Invoice data:  name and surname / company name, address, tax identification number,

  • Data for enrollment on the list of interested persons:  name, email address.

The scope of personal data processed by the Administrator depends on the purpose of processing.

3. For what purposes and on what legal grounds do we process personal data

The legal grounds and purposes of processing Users' personal data by the Administrator are as follows:

  • Users' data (including the Patient and Specialist) to contact: the legitimate interest pursued by the Administrator in order to respond to inquiries and to obtain an opinion on the Website and the quality of consultations (Article 6 (1) (f) of the GDPR)

  • Data necessary to conclude a distance contract on the Website - the legal basis is the contract, and the data is processed for its implementation (Article 6 (1) (b) of the GDPR)

  • Data for the invoice: legal obligation incumbent on the Administrator to fulfill tax and accounting obligations (Article 6 (1) (c) of the GDPR)

  • Data of special categories: consent of the data subject to processing for a specific purpose (Article 9 (2) (a) of the GDPR)

4. How long do we process the data

The time of processing Users' personal data by the Administrator depends on the purpose for which these data are processed and is:

  • Contact details: for the duration of correspondence with the User and answering his questions, and for 30 days from the date of its completion

  • Invoice data: for 5 years from the end of the year in which the Telemedicine Consultation was purchased or a corrective invoice was issued.

  • Data necessary to conclude the contract: for the duration of the contract and the limitation of any claims.

  • Data of special categories: 14 days from the date of the Telemedicine Consultation or the moment of withdrawal of consent by the data subject, if earlier.

5. Is it necessary to provide personal data

Providing data is voluntary, but necessary for the implementation of specific processing purposes, in particular for the implementation of the Telemedicine Consultation. Failure to provide the data will mean the inability to use the Website as a Patient or Specialist and the inability to conclude a contract.

6. Who can access personal data

  1. The administrator may entrust personal data to other entities, e.g. technology and service providers supporting the process of achieving the goals indicated in the previous points.

  2. The Administrator may disclose personal data to entities and bodies to which the Administrator is obliged or authorized to disclose them on the basis of generally applicable provisions of law, including entities or bodies authorized to receive personal data from the Administrator or authorized to request access to personal data on the basis of generally applicable provisions of law. .

  3. The User's personal data will not be transferred to recipients from third countries or international organizations that do not provide an adequate level of protection. The appropriate level of protection must be confirmed by an appropriate decision of the European Commission or another binding legal instrument.

  4. The administrator guarantees the confidentiality of all personal data provided to him.

7. The data is processed in accordance with the law

Personal data is collected with due diligence and properly protected against access by unauthorized persons, and their processing is carried out in accordance with and under the conditions set out in detail in:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC,

  • the Act of July 18, 2002 on the provision of electronic services,

  • the Act of May 10, 2018 on the protection of personal data.

8. What are the rights of the persons whose data is processed

  1. The User has the rights related to the processing of his personal data, including:

    • the right to access data

    • the right to correct the data

    • the right to limit data processing

    • the right to object to data processing

    • the right to delete data (the so-called right to be forgotten)

    • the right to data portability

    • the right to lodge a complaint with the supervisory body in relation to the processing of personal data by the Administrator

  2. The User has the right to withdraw his consent at any time if the User previously gave such consent.

9. What other information do we collect

  1. When the User uses the Website, the User's data is automatically collected. These data include, among others: IP address, domain name, browser type, operating system type. This data can be collected by cookies (so-called cookies), and can also be saved in the server logs. These data are not used to identify the User.

  2. Cookie files (so-called cookies) are files sent to a computer or other device (e.g. laptop, smartphone, tablet) of the User and saved there when browsing the Website. Cookies remember the User's preferences, which allows improving the quality of services provided, improving search results and the accuracy of the information displayed, and anonymous tracking of the User's preferences.

  3. The consent to store or access cookies by the Administrator on his device is expressed by the User using the settings of the browser installed on the User's device.

  4. The user may opt out of cookies by selecting the appropriate settings in the browser used by him. In such a situation, the use of the Website by the User may be difficult (e.g. it may work slower).

  5. The User may delete existing cookies from the device by using the appropriate functions of the web browser, programs for this purpose or by using the appropriate tools available under the operating system used by the User.

  6. The data stored in the server logs or using cookies are not combined in any way with specific Website Users and are not used by the Administrator to identify the User. The server logs are used to administer the Website, and their content is not disclosed to anyone except those authorized to administer the server.

  7. The Website uses the recording technologies anonimowo the actions taken by the User while using the Website. These include:

    • Google Analytics - used to analyze the website statistics

    • Facebook Pixel - used to manage and optimize Facebook advertising

  8. The data obtained by these tools are not combined in any way with specific Website Users and are not used by the Administrator to identify the User.

  9. The consequence of using these technologies will be the optimization of the Website, its content and the offer of services to the User's needs.

  10. The information collected in this way  is used by the Administrator to:

    • proper functioning, configuration and security of the Website,

    • monitoring the session status,

    • analysis, research and audit of Website views,

    • as well as for statistical and marketing purposes.

10. Final provisions

  1. This Privacy and Cookie Policy may change, which may be influenced by the development of internet technology, changes in the law on the protection of personal data and the development of our Website. Any changes will be communicated to Users immediately, in a visible and understandable way.
